Title

A RESOLUTION authorizing the County Executive to execute general warranty deeds in favor of the City of Kansas City, accepting a fee conveyance by general warranty deed from the City, and authorizing the County Executive to execute a Land and Water Conservation Fund Project Amendment with the Missouri Department of Natural Resources, in connection with a bridge replacement adjacent to the Little Blue Trace Park.

RESOLUTION # 13737, June 25, 2001

Body

WHEREAS, the City of Kansas City, MO, is planning to replace a bridge over the Little Blue River on Bannister Road, adjacent to the County's Little Blue Trace Park; and,

 

WHEREAS, in connection with this construction, the City must acquire title to 2.37 acres of park property; and,

 

WHEREAS, because this park property was acquired with federal funds from the National Park Service, through the Missouri Department of Natural Resources, the County may transfer title to this property only if the County at the same time acquires title to replacement property of equal or greater value; and,

 

WHEREAS, the City has offered, and the Director of Parks and Recreation and National Park Service have approved, replacement property of the same value, all property as described in the attached warranty deeds; and,

WHEREAS, the attached Land and Water Conservation Fund Project Amendment is necessary to finalize this arrangement; and,

 

WHEREAS, the conveyances described in this resolution are in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the above-described conveyance instruments in favor of the City of Kansas City, MO; and,

 

BE IT FURTHER RESOLVED that the above-described conveyance by general warranty deed from the City of Kansas City, be and hereby is accepted; and,

 

BE IT FURTHER RESOLVED that the County Executive be and hereby is authorized to execute the attached Land and Water Conservation Fund Project Amendment and any and all other documents necessary to consummate this transaction.

 

Enacted and Approved

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
