Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District, so that there will be transferred from District A to District RR, a tract of land described as follows:

Description:

 

The 15 ± acres are generally located east of Hillside School Road on the south side of J.W. Cummins Road specifically described as a part of the northwest quarter of the northwest quarter of Section 29, Township 48, Range 29 in Jackson County, Missouri and being more particularly described as follows:  Commencing at the northeast corner of the northwest quarter of the northwest quarter of Section 29, Township 48, Range 29 in Jackson County, Missouri:  thence north 88 degrees, 21 minutes, 10 seconds west, 337.03 feet along the north line of said northwest quarter section to the true point of beginning of this description; thence south 01 degree, 47 minutes, 14 seconds west, 1292.48 feet to a point on the south line of the northwest quarter of the northwest quarter of said Section 29; thence north 88 degrees, 21 minutes, 10 seconds west, 505.54 feet along the south line of said quarter, quarter section; thence north 61 degrees, 47 minutes, 14 seconds east 1292.48 feet to a point on the north line of said Section 29; thence south 88 degrees, 21 minutes, 10 seconds east, 505.54 feet along the north line of said Section 29 to the true point of beginning of this description aka 37401 J.W. Cummins Road.

 

 

 

Section 2.  The Jackson County Plan Commission, on June 16, 2005 held a public hearing and accepted testimony pertaining to the change of zoning requested by Connie Wheeler.  This request is consistent with the intent and purpose of the Master Plan, therefore, the Plan Commission voted 8 to 0 to recommend DISAPPROVAL to the County Legislature.

 

Section 3.  The Legislature, pursuant to the application of Connie Wheeler  (RZ-2005-369), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission unanimously recommended DISAPPROVAL of this application in a public hearing on June 16, 2005, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

 

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
