Body
WHEREAS, the City of Independence, Missouri ("City"), acting through the 39th Street Transportation Development District, is in the planning stages of a road improvement project to replace the existing bridge crossing the Little Blue Trace Park at 39th Street; and,
WHEREAS, 0.19 acre of needed right-of-way lies within park property which was acquired in 1972 with Land and Water Conservation Funds; and,
WHEREAS, the City proposes to replace the 0.19 acres with a 0.28-acre tract adjacent to the same park, located approximately two miles north of the tract sought; and,
WHEREAS, the replacement property is acceptable to the Director of Parks and Recreation; and,
WHEREAS, the transfer of this park property has been approved by the Missouri Department of Natural Resources and the U. S. Department of Interior; and,
WHEREAS, any negative effects from the loss of park land will be offset by the replacement parcel; and,
WHEREAS, the attached warranty deeds provide a suitable mechanism by which to accomplish the transfers; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached General Warranty Deed conveying 0.19 acres of park property within the Little Blue Trace Park to the City of Independence, Missouri; and,
BE IT FURTHER RESOLVED that the conveyance of the replacement parcel, a 0.28 acre tract adjacent to Little Blue Trace Park, from the City of Independence, Missouri, be and hereby is accepted.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
