AN ORDINANCE enacting §§ 4028. and 4029., Jackson County Code, 1984, relating to the permitting of food handlers, with a penalty provision and an effective date.

Body

WHEREAS, the Director of Public Works recommends that all food handlers at establishments operating under the County's jurisdiction receive training in safe and proper procedures for the handling of food; and,

 

WHEREAS, the Health Department of the City of Independence, Missouri, is able to provide food handler training and the issuance of food handler permits to those employed by food establishments within the County's jurisdiction; and,

 

WHEREAS, the City currently charges a $15.00 fee for such training and permits, which fee would not apply to persons working without compensation for a nonprofit entity or to persons aged 65 or older; and,

 

WHEREAS; the permits are currently valid for a period of three years; and,

 

WHEREAS, the County would not impose any additional fee for such training and permit; and,

WHEREAS, the requirement of such training and permitting is in the best interests of the health, welfare, and safety, of the citizens of Jackson County; now therefore,

 

BE IT ORDAINED by the County Legislature of Jackson County, Missouri, as follows:

 

Section A.  Enacting Clause.

                     Sections 4028. and 4029., Jackson County Code, 1984, are hereby enacted,  to read as follows:

 

4028.  Food Handler, Permit Required.

No person shall prepare, handle, or dispense food for human consumption, or come into contact with food or food preparation utensils, at any Food Establishment, unless that person has applied for and obtained a food handler permit, with fifteen days of commencement of employment or operation of an establishment, from the City of Independence, Missouri, Health Department.

 

4028.1   Permit, Standards.

The issuance of food handler permits shall be governed by the standards imposed by the City of Independence as to fee, required training, and duration, then in effect at the time of application.

 

4028.2 Permit, Disposition and Display.

Each holder of a permit required under this section shall keep said permit on his or her person at all times while working in a Food Establishment.

 

4028.3  Permit, Failure to Produce.

Failure of any person to produce a valid food handler permit upon the demand of the Health Officer shall be presumptive evidence that such person is not a permitted food handler, in violation of this section.

 

4029.   Food Establishment Operator Not to Permit Violation.

No holder of a permit to operate a Food Establishment shall suffer or allow any person in such establishment to prepare, handle, or dispense food for human consumption, or come into contact with food or food preparation utensils, unless that person has applied for and obtained, within fifteen days of commencement of employment or operation of the establishment, a food handler permit from the City of Independence Health Department,

 

4029.1   Food Establishment Operator, Maintenance of Listing Required.

Each holder of a Food Establishment permit shall maintain a listing of all employees who possess food handler permits, which listing shall be updated at least once every three months.

 

Section B.  Penalty Provision.

                     Any violation of this ordinance shall be punishable pursuant to § 4051., Jackson County Code, 1984.

 

Section C.  Effective Date and Transaction Schedule.

                     This Ordinance shall be effective as of June 1, 2003, for all persons commencing employment in a Food Establishment on or after that date.  For those persons already employed at a Food Establishment as of May 31, 2003, a food handler permit must be applied for and obtained during the period indicated below for establishments located in the respective cities and unincorporated Jackson County, under the jurisdiction of the Jackson County Public Works Department.

 

a.                       Lee's Summit, Lone Jack, and Greenwood.

                     June 1 through July 31, 2003.

 

b.                       Blue Springs, Oak Grove, Grain Valley, and Buckner.

                     August 1 through September 30, 2003.

 

c.                       Raytown.

                     October 1 through October 31, 2003.

 

d.                       Grandview.

                     November 1 through November 30, 2003.

e.                      Sugar Creek and Unincorporated Jackson County.

                     December 1 through December 31, 2003.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its passage by the County Executive.
