BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "LB-p" (Local Business - Planned Development) District and the "LI-p" (Light Industrial - Planned Development) District, so that there will be transferred from District LB-p to District LI-p, a tract of land described as follows:
Description: The 5 ± acres are generally located east of Sam Moore Road on the south side of U.S. 50 Highway adjacent to Johnson County, Missouri and specifically described as all that part of the East one-half of the Southeast Quarter of Section 21, Township 47, Range 29, Jackson County, Missouri, described as follows:
Beginning at a point on the East line of said East half, said point also being the South Right-of-Way line of State Highway U.S. Route 50 as now established, U.S. Route 50 centerline Station 1456+42.64 said point being 100 feet Southerly as measured at right angles from U.S. Route 50 centerline; thence South 02 degrees 01 minutes 05 seconds West along the East line of said East half, 488.86 feet; thence North 87 degrees 22 minutes 57 seconds West, 447.01 feet; thence North 02 degrees 01 minutes 05 seconds East, 486.14 feet to a point on the South Right of Way line of State Highway U.S. Route 50 centerline Station 1451+95.83 being 100 feet South as measured at right angles from U.S. Route 50 centerline; thence South 87 degrees 46 minutes 47 seconds East along said Right of Way line, 146.28 feet to an angle point at centerline Station 1453+42.17 being 100 feet Southerly as measured at right angles from U.S. Route 50 centerline; thence South 87 degrees 42 minutes 19 seconds East along said Right of Way line, 300.71 feet to the Point of Beginning. Containing 5.00 acres, more or less.
Section 2. The Legislature, pursuant to the application of CNG Enterprises (RZ-2006-420), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission by a vote of 7 to 1 recommended Disapproval of this application at a public hearing on December 21, 2006, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
