IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI Title AN ORDINANCE repealing 1311., Jackson County Code, 1984, relating to court costs, and enacting, in lieu thereof, one new section relating to the same subject. Intro ORDINANCE 2525, April 1, 1996 INTRODUCED BY Victor E. Callahan, County Legislator Body WHEREAS, 590.140, RSMo 1994, allows for the imposition, by ordinance, of an additional $1.00 fee to be assessed as court costs in all actions for the violation of county ordinances, except nonmoving traffic violations and violations of fish and game regulations; and, WHEREAS, the proceeds of this fee are to be transmitted to the state treasurer for deposit into the Peace Officer Standards and Training (POST) Commission Fund; and, WHEREAS, monies in the POST Commission Fund are available to local law enforcement agencies who apply therefor to assist the agencies in paying for training for their officers; and, WHEREAS, only those agencies whose governing bodies have imposed the fee are eligible to apply for POST Commission funding; and, WHEREAS, the Sheriff and Director of Parks and Recreation recommend adoption of this ordinance so as to allow their agencies to participate in POST Commission funding; and, WHEREAS, the adoption of this ordinance is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore, BE IT ORDAINED by the County Legislature of Jackson County, Missouri, as follows: Section A. Enacting Clause. Section 1311., Jackson County Code, 1984, is hereby repealed and one new section enacted in lieu thereof, to be known as 1311., to read as follows: 1311. Additional Court Costs. The official responsible for collecting court costs and fines shall, in addition to costs otherwise allowed by law, assess as court costs the amount of [two] three dollars ($[2] 3) for each court proceeding filed in any court in Jackson County for violations of the general criminal laws of the state, including infractions of violations of Jackson County Ordinances. 1311.1 No Fee, Certain Cases [for Nonmoving Traffic Violation]. The fee shall not be imposed or collected for nonmoving traffic violations nor for violations of state fish and game regulations. 1311.2 No Fee When Dismissed. No fee shall be imposed or collected in any proceeding in any court when the proceeding or defendant has been dismissed. 1311.3 Use Of Fees. The fees collected shall be [transmitted monthly to the Director of Revenue to be used for the training of Jackson County law enforcement officers.] allocated in the following manner: a) Two dollars for each case shall be transmitted monthly to the Manager of Administration to be used for the training of Jackson County law enforcement officers, including park rangers; and, b) One dollar for each case shall be transmitted to the state treasury for credit to the credit of the Peace Officer Standards and Training Commission Fund, to be used for training of law enforcement officers statewide. Attorney Effective Date: This Ordinance shall be effective immediately upon its passage by the County Executive.
