AN ORDINANCE approving a conditional use permit (CUP) in District LB (Local Business) for a period of 5 years subject to conditions, to continue operating a bar serving alcoholic beverages.

ORDINANCE # 3276,  August 5, 2002

 

 

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  A conditional use permit for a period of five years to continue operating a bar serving alcoholic beverages, under the Unified Development Code, is hereby approved as to a certain tract of land described as follows:

DESCRIPTION:

 

A 1.0 ± acre tract of land generally located at the northwest corner of Colbern Road and Shrout Road and specifically described as all that part of the Southwest One-Quarter of the Northwest One-Quarter of Section 29, Township 48, Range 30, in Jackson County, Missouri, described as follows: Beginning at the Southeast corner of said Quarter Quarter Section; thence North 208.71 feet; thence West 208.71 feet; thence South 208.71 feet; thence East 208.71 feet to the point of beginning, aka 27906 E. Colbern Road.

                     

                     The place of business is knows as Midway Bar & Grill.

 

 

Section 2.  The conditional use permit granted by this ordinance is subject to the following conditions:

 

1.                     That the Proprietor shall provide copies of applicable State and County Liquor Licenses to the Public Works Development Division on annual renewal dates.

 

2.                     That the Proprietor shall comply with Jackson County Code, Chapter 40 (Sanitation Ordinance).

 

3.                     That the Proprietor shall comply with Jackson County Code, Chapter 41 (Alcoholic  Beverages) as well as Chapter 311 RSMo (Liquor Control Law).

Section 3.  The Legislature, pursuant to the application of  Christina Jo Bowlin of Prestana Inc., (CU-2002-164), requesting approval embodied in this ordinance and with notice that the Jackson County Planning Commission unanimously recommended approval of this application in a public hearing on July 18, 2002, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
