Body
WHEREAS, by Ordinance 2717, dated August 25, 1997, the Legislature did submit to the qualified voters of sewer district 102 (Carriage Oaks) at a special election held on November 4, 1997, the question of whether the Legislature should be authorized to impose a monthly flat sewer fee on all improved lots (those having a structure built thereon) within the district, in an amount not to exceed $43.70; and,
WHEREAS, the voters at said election did approve the question; and,
WHEREAS, it is in the best interest of the health, welfare, and safety of the citizens of Jackson County that the fee authorized by the voters of the district be imposed at the maximum rate; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that, effective January 1, 1998, a monthly flat sewer fee in the amount of $43.70 per lot, be and hereby is imposed upon all improved lots within sewer district 102 (Carriage Oaks); and,
BE IT FURTHER ORDAINED that Schedule I to Chapter 31, Jackson County Code, 1984, be and hereby is amended, as follows:

Multiple-Family Residence served by

Multiple-Family Residences Served by One Meter and Businesses. The monthly charge for multiple family residences served by a single water meter, for hotels, dormitories, institutions, motels, business, commercial and industrial properties, and any residence occupied as a business, operated as a single enterprise on premises not separated by a public thoroughfare not including sewerage services involving a special rate under the provisions of Sections 3162.00 and 3144.00 shall be based on the quantity of water used on the premises furnished with the sewerage services shall apply according to the following schedule:
a. Minimum Charge charge per month
for each user $14.27
b. The following rates shall apply:
First 400 cubic feet or less $14.27
From 400 cubic feet to 13,300 $ .46
cubic feet per month per 100 cubic feet
From 13,300 cubic feet to 26,600 $ .38
per 100 cubic feet
From 26,600 cubic feet to 40,000 $ .28
cubic feet per month per 100 cubic feet
For over 40,000 cubic feet $ .14
per month per 100 cubic feet

Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
