BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District, so that there will be transferred from District A to District RE, a tract of land described as follows:

Description:

                     

A 12± acre tract of land generally located 6/10 of a mile east of Lefholz Road on the south side of Jim Owings Road and specifically described as follows:

 

All that part of the W ½ of the SE 1/4 of section 30-T.49-R.29, Jackson County, Missouri described as follows: Commencing at the NE corner of said SE 1/4; thence N 88 degrees, 13 minutes, 17 seconds W, along the north line of said SE 1/4, 1319.65 feet to the NE corner of the W ½ of said SE 1/4; thence N 88 degrees, 13 minutes, 17 seconds W, continuing along said north line, 33.00 feet to the point of beginning of the tract to be described herein; thence S 01 degrees, 52 minutes, 54 seconds W, parallel with the east line of said W ½, 78.57 feet to the south right-of-way line of Jim Owings Road as established by document in road record book 14 at page 446; thence N 87 degrees, 54 minutes, 25 seconds W, along said line, 20.00 feet south of and parallel with the centerline thereof, 15.00; thence S 01 degrees, 52 minutes, 54 seconds W, parallel with the east line of said W ½, 690.85 feet; thence N 88 degrees, 07 minutes, 06 seconds W, 208.01 feet; thence S 01 degrees, 52 minutes, 54 seconds W, 1184.66 feet tot he south right-of-way line of said Jim Owings Road; thence N 87 degrees, 54 minutes, 25 seconds W, along said line, 20.00 feet south of and parallel with the centerline thereof, 8.31 feet to the west line of a tract of land described in document number 2000-I-0079170'; thence N 01 degrees, 59 minutes, 49 seconds E, along said line, 75.73 feet to a point on the north line of said W ½ said point being S 88 degrees, 13 minutes, 17 seconds E, along said line, 768 feet from the NW corner of said SE 1/4; thence S 88 degrees, 13 minutes, 17 seconds E, along said line, 5 18.65 feet to the point of beginning. 

 

 

Section 2.  The Legislature, pursuant to the application of Theron Crall and Ed Textor   (RZ-2004-359), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission, by a 6 to 0 vote, unanimously recommended Disapproval of this application in a public hearing on December 16, 2004, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
