BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District so that there will be transferred from District A to District RE a tract of land described as follows:
Description: A 80 ± acre tract of land generally located ½ mile south of Herring road on the west side of Missouri 7 Highway and more specifically described as:
Part of the E ½ of Section 19, Township 47 North, Range 30 West, in Jackson County, Missouri, more particularly described as follows: Beginning at the East 1/4 corner of said Section 19, thence S 02°24'45" W along the East line of said Section 19, a distance of 656.29 feet; thence N 89°56'52" W, a distance of 2652.00 feet to a point on the West line of the East ½ of Said Section 19, thence N 02°38'44"E along said West line, a distance of 658.34 feet to the Center of said Section 19; thence N 02°34'51" E continuing along the West line of the East ½ of said Section 19, a distance of 659.75 feet; thence S 89°54'20" E, a distance of 2647.37 feet to a point on the East line of the East ½ of said Section 19' thence S 02°24'45" W along said East line, a distance of 659.63 feet to the Point of Beginning, containing 80.012 acres, more or less, all being subject to easements, rights of way, and restrictions of record, aka 13520 S. Missouri 7 Highway.
Section 2. The preliminary plat "Oakhaven," creating a twenty-one lot residential subdivision, is hereby approved.
Section 3. The Legislature, pursuant to the application of David Lampton (RZ-2001-222), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on February 15, 2001, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
