BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District, so that there will be transferred from District A to District RE, a tract of land described as follows:

Description:

 

The 3.1 ± acres are approximately ½ mile north of Nebgen Road on the west side of Oak Hill School Road and more specifically described as:

 

All that part of the Southwest Quarter of the Southeast Quarter of Section 11, Township 48, Range 30, all in Jackson County, Missouri, and being a part of the same property described in Document No. 200310066660, Dated June 5th, 2003, filed in the Recorded of Deeds Office for Jackson County, and now being more fully described as follows: Commencing at the Southeast Corner of the Southeast Quarter of Section 11, Township 48, Range 30, Jackson County, Missouri; thence North 87 degrees 49 minutes 14 seconds West (this bearing and all following bearings being based on Grid North from the Missouri State Plan Coordinate system and referenced to the Jackson County Control Station JA-11 and established using RTK GPS equipment) 1294.93 feet to the Southeast Corner of the Southwest Quarter of the Southeast Quarter of said Section 11; thence North 02 degrees 01 minutes 27 seconds East along the East line of the Southwest Quarter of the Southeast Quarter of said Section 11, a distance of 17.26 feet; thence North 87 degrees 49 minutes 14 seconds West along a line 17.26 feet North of and parallel to the South line of the Southwest Quarter of the Southeast Quarter of said Section 11, a distance of 40.00 feet to the TRUE POINT OF BEGINNING, thence North 87 degrees 49 minutes 14 seconds West along a line 17.26 feet North of and parallel to the South line of the Southwest Quarter of the Southeast Quarter of said Section 11, a distance of 342.70 feet; thence North 59 degrees 33 minutes 11 seconds West 274.59 feet; thence North 02 degrees 01 minutes 27 seconds East, 50.00 feet; thence North 63 degrees 36 minutes 02 seconds East 221.51 feet; thence South 88 degrees 39 minutes 28 seconds East, 389.41 feet; thence South 02 degrees 01 minutes 27 seconds West along a line 40.00 feet West of and parallel to the East line of the Southwest Quarter of the Southeast Quarter of said Section 11, a distance of 296.70 feet to the True Point Of Beginning, containing 3.087 acres of land.

 

 

Section 2.  The Legislature, pursuant to the application of Teresa Whetstone (RZ-2004-330), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on March 18, 2004, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

 

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
