AN ORDINANCE repealing sections 280. and 7030., Jackson County Code, 1984, relating to the salaries of certain elected officials, and enacting, in lieu thereof, two new sections relating to the same subject.

Body

WHEREAS, during their deliberations in 1970, the framers of the Constitutional Home Rule Charter of Jackson County set the compensation of the Jackson County Prosecuting Attorney at the same salary being paid to Circuit Court judges of the State of Missouri, then $22,500; and,

 

WHEREAS, by the time the charter became effective on January 1, 1973, the salary of circuit judges had risen to $25,000 pursuant to an act of the Missouri General Assembly; and,

 

WHEREAS, the salary for the office of Sheriff, originally set by the charter at $17,500, has also declined compared to the salary of circuit judges, which is now $108,000; and,

 

WHEREAS, the Legislature now believes it appropriate that , for their upcoming terms, the salaries of these officers be set at the same ratios as those salaries bore to that of a circuit judge in 1973, 90% for the Prosecuting Attorney and 70% for the Sheriff; and,

WHEREAS, if these salaries were to be effective now, the Prosecuting Attorney would be paid $97,200 annually and the Sheriff $75,600 annually; now therefore,

 

BE IT ORDAINED by the County Legislature of Jackson County, Missouri, as follows:

 

Section A.                       Enacting Clause.  Sections 280. and 7030., Jackson County Code, 1984, are hereby repealed, and two new sections enacted in lieu thereof, to be known as sections 280. and 7030., to read as follows:

 

280.                     Prosecuting Attorney, Salary.

The annual compensation of the Prosecuting Attorney of Jackson County, Missouri is set at [$88,982 per annum,] 90% of the salary paid by the State of Missouri to circuit judges of the Sixteenth Judicial Circuit of Missouri as of January 1 of each year of any [for the] term beginning on or after January 1, [1997] 2005, pursuant to Article II, Section 16 of the Constitutional Home Rule Charter of Jackson County.  At no time shall the compensation of the Prosecuting Attorney ever be reduced as a result of this provision.

 

7030.   Sheriff, Compensation.

Effective January 1, [1997] 2005, the Sheriff of Jackson County, Missouri shall receive an annual salary [of $65,000] equal to 70% of the salary paid by the State of Missouri to circuit judges of the Sixteenth Judicial Circuit of Missouri as of January 1 of each year of the Sheriff's term.  At no time shall the salary of the Sheriff ever be reduced as a result of this provision.

 

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
