Body
WHEREAS, it has become necessary, in connection with the Buckner Tarsney Road Bridge Project, Tract No. 2, No. 2264, to acquire a right-of-way, and to cause certain damage to, the property of a certain property owner, C. J. Controls, Inc., in the amount of $15,335.00; and,
WHEREAS, the owner has agreed to convey said right-of-way, and to settle the claim for damages and has executed the attached conveyance in favor of the County in consideration of the total payment of $15,335.00; and,
WHEREAS, in connection with the same project, it may also be necessary to acquire a temporary construction easement over other property belonging to the same owner; and,
WHEREAS, the necessity of the acquisition of this easement will be determined at a later date, as the design phase of the project progresses; and,
WHEREAS, in the event that the acquisition of this temporary construction easement does become necessary, the owner has agreed to convey it to the County in consideration of the payment of an additional $5,915; and,
WHEREAS, a transfer within the 1997 Special Road and Bridge Fund is necessary to cover the costs of this acquisition and other right- of-way acquisitions which will be required throughout the remainder of 1997; and,
WHEREAS, the County Executive has recommended said transfer; therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the following transfer be made within the 1997 Special Road and Bridge Fund:

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
