Body
BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. A conditional use permit is hereby granted for a period of fifteen years to operate a childcare center, as to an approximate .49+ acre tract of land generally located on the north side of Duncan Road approximately one-half mile east of R.D. Mize Road and specifically described as follows:
Description: The 0.49 ± acre tract is located on the north side of Duncan Road approximately ½ mile east of R.D. Mize Road and specifically described as part of the northeast quarter of Section 26, Township 49, Range 31, Jackson County, Missouri, described as follows: beginning at a point in the center line of R.D. Mize Road, said point being 1157 feet east of the west line of the northeast quarter of Section 26, thence north 270 feet; thence west 88 feet; thence south 270 feet to a point in the center of R.D. Mize Road; thence east 88 feet to the Point Of Beginning, except that part in R.D. Mize Road, aka 3255 NW Duncan Road.
Section 2. The conditional use permit granted by this Ordinance is subject to the following conditions:
1. That applicant complies with all conditions contained within section 24005.6 of the Unified Development Code, relating to Child Day Care Centers.
2. That the applicant submit copies of all licenses upon renewal from the Missouri Department of Health and Senior Services and any other agency as required by law to the Planning and Environmental Health Division.
3. That all driveways and parking areas located on subject tract be surfaced and paved.
4. The outdoor play area of the child day care center shall be enclosed with a fence, which shall have a minimum height of four feet.
5. The septic tank and propane tank shall be enclosed with a fence that has a minimum height of four feet and be inaccessible to children.
Section 3. The Legislature, pursuant to the application of Sally Jackson d/b/a Color Us Kids Family Childcare (CU-2011-208), requesting approval embodied in this Ordinance and with notice that the Jackson County Plan Commission voted 8 to 0 to recommend APPROVAL of this application in a public hearing on July 21, 2011, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
