A RESOLUTION authorizing the County Executive to execute an agreement granting permanent and temporary construction easements to the Public Water Supply District #17 to permit the installation, operation and maintenance of a water line through a portion of Monkey Mountain Park.

Body

WHEREAS, Public Water Supply District #17 ("District") has submitted a request for a permanent and temporary construction easements through a portion of Monkey Mountain Park to permit the installation, operation and maintenance of a twenty (20) foot wide water line for service to District residents;  and,

 

WHEREAS, the Director of Parks and Recreation has determined that  these easements will have no adverse effect on the Park; and,

 

WHEREAS, the granting of these easements is in the best interests of the health, welfare, and safety of the citizens of Jackson County; and,

 

WHEREAS, the Director of the Parks and Recreation and the District have negotiated and recommend the terms of the attached easement agreement; now therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the attached easement agreement be and hereby is approved and that the County Executive be and hereby is authorized to execute the agreement on behalf of the County.

 

 

Enacted and Approved

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
