BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District, so that there will be transferred from District A to District RE, a tract of land described as follows:

Description:

 

The 3.4± acres generally located ½ mile east of Howard Road on the north side of Milton Thompson Road and is specifically described in the Attached Exhibit "A".

 

A parcel of land in the Northeast Quarter and the Southeast Quarter of Section 36, Township 48 North, Range 31 West, in Jackson County, Missouri, described as follows; Commencing at the southeast corner of said Northeast Quarter; thence North 88 Degrees 09 Minutes 05 Seconds West along the south line of said quarter section, a distance of 194.20 feet to a point on the west line of SCHLUETER ADDITION, a subdivision of Record, said point being the POINT OF BEGINNING of said parcel; thence North 01 Degrees 40 Minutes 08 Seconds East along the west line of said subdivision, a distance of 225.74 feet; thence North 88 Degrees 09 Minutes 05 Seconds West, a distance of 353.40 feet; thence South 01 Degrees 40 Minutes 08 Seconds West, a distance of 520.01 feet to a point on the south line of Milton Thompson Road as established (40 foot from the centerline by deed); thence North 63 Degrees 20 Minutes 58 Seconds East along said right of way, a distance of 354.46 feet; thence easterly along said right of way on a curve to the right, having a radius of 756.78 feet, a chord bearing of North 65 Degrees 06 Minutes 02 Seconds East, an arc length of 46.26 feet to the southwest corner of said SCHLUETER ADDITION; thence North 01 Degrees 40 Minutes 08 Seconds East along the west line of said subdivision, a distance of 104.32 feet to the POINT OF BEGINNING, aka 25810 E. Milton Thompson Road.                     

 

Section 2.  The Jackson County Plan Commission, on May 19, 2005, held a public hearing and accepted testimony pertaining to the change of zoning requested by Linda Ryder.  This request is consistent with the intent and purpose of the Master Plan, therefore, the Plan Commission voted 7 to 0 with 1 abstention to recommend APPROVAL to the County Legislature.

 

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
