AN ORDINANCE amending the districts established by the Jackson County Zoning Order by changing from A (Agricultural) to RE (Residential Estates), a certain 15 ± acre tract.

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District so that there will be transferred from District A to District RE a tract of land described as follows:

Description: A 15 ± acre tract generally located 1/4 of a mile north of Dillingham Road on the west side of Truman Road (Missouri Route FF) and is specifically described as:

 

All the West Half of the Northwest Quarter of the Northwest Quarter of Section 10, Township 49, Range 30, and 13 1/3 acres off the East side of the Northeast Quarter of the Northeast Quarter of Section 9, Township 49, Range 30, all in Jackson County, Missouri except 1 acre in the Northwest corner thereof and except a strip of land 12 feet in width off the South end of each said tracts, and except described tracts:

 

Beginning at the Southeast corner of the Cemetery lot in the Northeast Quarter of the Northeast  Quarter of Section 9, Township 49, Range 30; thence East to the East line of the West Half of the Northwest Quarter of the Northwest Quarter of Section 10, Township 49, Range 30, said point being in the center line of the County Road (known as Truman Road); thence North along the center line of said County Road to the North line of said Section 10; thence West along the  North line of said Sections 10 and 9 to the Northeast corner of said Cemetery lot; thence South 313.06 feet to the beginning, and except that part conveyed to Elwood L. Courtwright and wife Mary, in instrument recorded July 25, 1956 as Document 668368 in Book 1218, at Page 81 in Jackson County, Missouri, and now being more fully and correctly described as follows:

 

Beginning at a point on the West line of the Northwest quarter of the Northwest Quarter of Section 10, Township 49, Range 30, said point being South 01 degrees 39 minutes 49 seconds West (this bearing and all following bearings being based on the State Plane Coordinate system Grid North and being referenced to Station JA-03), 701.54 feet from the Northwest corner of the Northwest Quarter of the Northwest Quarter of said Section 10, said point being on the South line of Lot 2, Lake Park a subdivision of land in Jackson County, Missouri; thence South 87 degrees 55 minutes 42 seconds East along the South line of said lot 2, a distance of 659.56 feet to a point on the East line of the West Half of the Northwest Quarter of the Northwest Quarter of said Section 10; thence South along said East line South 01 degrees 45 minutes 29 seconds West 588.04 feet to a point that is 12 feet North of the South line of the West Half of the Northwest Quarter of the Northwest Quarter of said Section 10; thence North 88 degrees 30 minutes 37 seconds West along a line parallel with the South line of the West Half of the Northwest Quarter of the Northwest Quarter of said Section 10, a distance of 658.62 feet to a point on the West line of the Northwest Quarter of the Northwest Quarter of said Section 10, said point being 12 feet North of the Southwest corner thereof; thence North 87 degrees 59 minutes 57 seconds West along a line 12 feet North of and parallel with the South line of the East Half of the Northeast Quarter of the Northeast Quarter of Section 9, Township 49, Range 30 for a distance of 442.57 feet to a point on the West line of the East 13 and 1/3 acres of the East Half of the Northeast Quarter of the Northeast Quarter of said Section 9; thence North 01 degrees 44 minutes 57 seconds East along the West line of the East 13 and 1/3 acres of the East Half of the Northeast Quarter of the Northeast Quarter of said Section 9, a distance of 585.96 feet; thence South 89 degrees 08 minutes 12 seconds East, 441.77 feet to the point of beginning, said tract containing 14.940 acres of land, less and except that part in Truman Road, aka 30907 E. Truman Road.

 

 

Section 2.  The Legislature, pursuant to the application of Steve Kent ( RZ-2003-295), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on March 20, 2003, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
