AN ORDINANCE appropriating $233,581.00 from the fund balance of the 2009 Grant Fund in acceptance of funding from the City of Independence, appropriating $175,186.00 from the fund balance of the 2009 Grant Fund in acceptance of federal funds from the Missouri Highway and Transportation Commission, and authorizing payment to the City of Independence in an amount not to exceed $175,186.00, all related to the Little Blue Trace Multipurpose Trail Improvement Project .

Body
WHEREAS, by Ordinance 3747, dated March 6, 2006, the Legislature did authorize the County Executive to execute a Program Agreement with the Missouri Highways and Transportation Commission for Little Blue Trace Bicycle Trail improvements; and,
WHEREAS, by Resolution 16466, dated December 3, 2007, and by Resolution 17051, dated October 26, 2009, the Legislature did authorize the County Executive to execute a Cooperative Agreement with the City of Independence and a First Amendment thereto which designates an obligation of payment from the City for it's portion of the project, in an amount not to exceed $233,581.00 and also designates an obligation to the County to reimburse the City in an amount not to exceed $175,186.00; and,
WHEREAS, a Supplemental Program Agreement, to be authorized by Resolution 17112, will combine the City and County grant projects into a single project, with the County receiving the City's federal grant funding from Missouri Highway and Transportation Commission in an amount not to exceed $175,186.00; and,
WHEREAS, an appropriation is necessary in order to place the grant funds and the City's payment in the appropriate spending accounts; and,
WHEREAS, the County Executive recommends said appropriation; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation from the fund balance of the 2009 Grant Fund be and hereby is made:
