WHEREAS, by Ordinance 3454, dated December 8, 2003, the Legislature adopted a formula to set new salaries for the Prosecuting Attorney and Sheriff, effective January 1, 2005, establishing salaries of these officers to reflect a ratio of 90% to that of a circuit judge as of January 1 of each year of any term for the Prosecuting Attorney and 70% to that of a circuit judge as of January 1 of each year of the Sheriff's term; and,
WHEREAS, by Ordinance 3522, dated August 9, 2004, the Legislature used a similar formula to set new salaries for the County Executive and the members of the Legislature, effective January 1, 2007, requiring that the computation of the salary be made as of January 1 of the year prior to the beginning of the term for the County Executive and the year prior to the beginning of the term for the members of the legislature; and,
WHEREAS, as set forth in Ordinance 3522 in relation to the salaries of the County Executive and the members of the Legislature, the Legislature believes it appropriate to require that the computation of salary for the Prosecuting Attorney and the Sheriff be made as of January 1 of the year prior to the beginning of their term; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, as follows:
Section A. Enacting Clause. Sections 280. and 7030., Jackson County Code, 1984, is hereby repealed, and two new sections enacted in lieu thereof, to be known as sections 280. and 7030., to read as follows:
280. Prosecuting Attorney, Salary.
The annual compensation of the Prosecuting Attorney of Jackson County, Missouri is set at 90% of the salary paid by the State of Missouri to circuit judges of the Sixteenth Judicial Circuit of Missouri [as of January 1 of each year of any term] as of January 1 of the year prior to the beginning of the Prosecuting Attorney's term beginning on or after January 1, 2005, pursuant to Article II, Section 16 of the Constitutional Home Rule Charter of Jackson County. At no time shall the compensation of the Prosecuting Attorney ever be reduced as a result of this provision.
7040. Sheriff. Compensation.
Effective January 1, 2005, the Sheriff of Jackson County, Missouri shall receive an annual salary equal to 70% of the salary paid by the State of Missouri to circuit judges of the Sixteenth Judicial Circuit of Missouri [as of January 1 of each year of the Sheriff's term.] as of January 1 of the year prior to the beginning of the Sheriff's term. At no time shall the salary of the Sheriff ever be reduced as a result of this provision.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
