AN ORDINANCE submitting to the qualified voters of Jackson County, Missouri at a special election to be held on April 4, 2000, a question authorizing Jackson County to impose a countywide sales tax at the rate of one-quarter of one percent for a period of eight years solely for the purposes of increased school safety, expanded 911 response, and justice facility improvements.

Body

WHEREAS, the County Legislature of Jackson County, Missouri, desires to propose to the voters of Jackson County a comprehensive plan to increase school safety and community safety; and,

 

WHEREAS, this comprehensive plan will address safety in schools, expanded 911 emergency response through the Sheriff's Department, and necessary enhancements to the County's civil and criminal justice facilities; and,

 

WHEREAS, in order to fund this comprehensive plan, the Legislature proposes to impose a sales tax at the rate of one-quarter of one percent for a period of eight years; therefore,

 

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

1.                     Section   Pursuant to the provisions of § 67.547, RSMo 1994, there is hereby called a special election to be held in Jackson County, Missouri, on April 4, 2000, for the purpose of submitting to the qualified voters of Jackson County, Missouri, a question for the imposition of a countywide sales tax at the rate of one-quarter of one percent for a period of eight years solely for the purpose of public safety and justice improvements.

 

2.                     Section                       The proceeds of this tax and interest therefrom shall be deposited in a special Jackson County Safe Schools and Safe Community Fund.  Any funds collected and interest earned from this tax must be segregated and not commingled with the general fund or any other special fund of the County.

 

3.                     Section                       The qualified voters at said election shall vote by ballot and the ballots to be used at said election shall contain the following language:

OFFICIAL BALLOT

 

                     Shall the County of Jackson impose a countywide sales tax at the rate of one-quarter of one percent for a period of eight years to create safer schools and a safer community by dedicating the proceeds of this tax solely to public safety improvements, including the 911 emergency response system in the sheriff's department, increased safety measures in the public schools, and improving the county's civil and criminal justice centers?  The proceeds of this tax shall be deposited in a special fund, separate from the general fund and any other special fund of the county.

If you are in favor of the question, place an "x" in the box opposite "Yes".  If you are opposed to the question, place an "x" in the box opposite "No".

 

4.                     Section                       If a majority of the qualified voters voting at said election shall vote in favor of the approval of this ordinance, then the same shall be binding and shall become effective on the first day of the second calendar quarter after the Missouri Director of Revenue receives notice of the adoption of the tax, October 1, 2000, and shall automatically terminate eight years after that date, September 30, 2008.

 

5.                     Section                       The Clerk of the Legislature is hereby authorized and directed to notify the Jackson County and Kansas City Boards of Election Commissioners of the adoption of this Ordinance no later than 5:00 p.m. on January 25, 2000, and to include in said notification all of the terms and provisions required by §115.125, RSMo Supp. 1999.

 

Enacted and Approved

Effective Date:  This ordinance shall be effective immediately upon its signature by the County Executive.
