BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
 
 
Section 1.  A conditional use permit (CUP) is hereby approved for a period of ten (10) years, to continue operation of a kennel as to a certain tract of land described as follows:
Description:
The 25 ± acres are approximately ½ ± mile north of County Line Road on the west side of Hamilton Road and more specifically, lying in the NW ¼ of the SW ¼ of Section 34, Township 47, Range 30 in Jackson County, Missouri being herein described as:
 
Commencing at the S.E. corner of said ¼ ¼ ; also being the NE corner of "LaDora-Acres", a subdivision of record in Jackson County, Missouri; thence N 89̊55'13" W on a Grid Bearing for a distance of 927.24 feet to the true point of beginning of the herein described tract; thence continuing N 89̊55'13" W for 390.70 feet to the SW corner of said ¼ ¼ ; thence N 2̊05'09" E for 1323.29 feet to the NW corner of said ¼ ¼ ; thence S 89̊58'12" E for 1320.45 feet to the NE corner of Said ¼ ¼ ; thence S 2̊09'37" W in Hamilton Road for 592.25 feet; thence N 89̊56'43" W and departing said road for 555.60 feet; thence S 1̊42'54" W for 70 feet; thence N 89̊56'43" W for 374.18 feet; thence S 2̊03'00" W for 661.78 feet to the point of beginning, aka 15118 Hamilton Road.
 
 
Section 2. The permit granted by this Ordinance is subject to the following conditions:
 
1.      That all enclosures, runways or exercising areas are located not less than 200 feet from all property lines.
 
2.      That the number of dogs kept at the kennel be limited to twenty-five (25).
 
3.      That the kennel shall be private and limited to only the property owners' dogs and shall not be operated as a boarding/commercial animal establishment.
4.      That all dogs must be contained in the kennel enclosures unless under the control of and obedient to the command of a responsible person.
 
 
Section 3.  The Legislature, pursuant to the application of Patricia Mann and Neila Gelvin, requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission unanimously recommended approval of this application at a public hearing on September 20, 2007, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
 
Enacted and Approved
 
Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
