AN ORDINANCE repealing sections 9056., 9057., and 9058., Jackson County Code, 1984, relating to the Housing Resources Commission, and enacting, in lieu thereof, three new sections relating to the same subject.

Body

WHEREAS, the County's homeless assistance program, funded by a fee on recorded documents, has been in existence since 1991, and is currently administered by the Housing Resources Commission established under sections 9056. through 9058. of the county code; and,

 

WHEREAS, over ten years of experience has revealed a need for changes in how the program is administered; and,

 

WHEREAS, the Legislature believes that this program can be more efficiently administered by a smaller commission staffed by the Office of the Legislature Auditor; now therefore,

 

BE IT ORDAINED by the County Legislature of Jackson County, Missouri, as follows:

 

Section A.                       Enacting Clause.

Sections 9056., 9057., and 9058., Jackson County Code, 1984, are hereby repealed, and three new sections enacted in lieu thereof, to be known as sections 9056., 9057., and 9058., to read as follows:

 

9056. [Special] Homeless Assistance Fund Created.

The [Manager of the Division of Finance] Chief Financial Officer shall deposit all fees paid over by the Director of the Department of Records pursuant to section 9055.2 in a special Homeless Assistance Fund to be expended only to provide financial assistance to agencies which serve homeless [families] persons, under such provisions as the Legislature shall adopt.  All interest accruing to this special fund shall remain with said fund and shall not revert to County general revenues.

 

9057. Establishment of Housing Resources Commission.

There is hereby established the Jackson County Housing Resources Commission, consisting of [nine] five members, who shall include the Legislator from the Second District, who shall serve as chairman, [a member of the staff of the Legislative Auditor as he shall designate, a member of the staff of the County Counselor as he shall designate,] and [six] four Jackson County residents who shall be appointed by the County Executive subject to disapproval by the County Legislature.  The term of each appointed member shall be three years[; provided, however, that of the first appointments, two persons shall be appointed for three years, two persons for two years, and two persons for one year].  Appointments to the commission made after the effective date of Ordinance 3463 shall, to the maximum extent possible, preserve the staggering of terms of office.  Any vacancy on the Commission shall be filled by appointment and approval in like manner for the unexpired portion of the term.  All members shall continue to serve until their successors have been appointed and qualified.  The Commission shall meet from time to time as it deems necessary.  A majority of the Commission shall constitute a quorum for the transaction of business.  Each member of the Commission shall serve without pay but may be reimbursed from the special fund created by section 9056. for moneys actually and necessarily expended in the performance of their duties under sections 9054. - 9058., but such reimbursement shall not exceed two and one-half percent of the fees collected annually pursuant to section 9054.

 

9058.  Administration of Homeless Assistance Fund[s by Housing Resources Commission].

Subject to the approval of the County Legislature, the Housing Resources Commission shall allocate and disburse the funds collected and appropriated pursuant to sections 9054.-9057. in the manner provided and set forth in sections 67.1062 et seq., RSMo, as amended.  The Office of the Legislative Auditor shall serve as staff to the commission and the commission shall have no authority to hire or retain any additional employees.   Any contracts entered into under the authority of this section shall be [subject to the approval of the County Legislature and] executed on the County's behalf by the County Executive.

 

 

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
