Body
WHEREAS, the Jackson County Parks and Recreations Department owns a certain gun range facility (the "facility") located at Landahl Park which is not open for use by the general public; and,
 
WHEREAS, the Sheriff's Office is presently permitted to use the facility strictly for use in training and certifying law enforcement staff of the Sheriff's Office; and,
 
WHEREAS, section 571.090, RSMo, relating to handgun or concealable firearms transfer permits, was repealed during 2007 in favor of the concealed carry endorsement provisions of sections 571.101 to 571.150, RSMo; and,
 
WHEREAS, the Sheriff's Office now recommends the additional use of the facility for the additional purposes of providing certification of applicants for firearms safety training required for concealed carry endorsements under the supervision of its deputies; and,
 
WHEREAS, the Sheriff's Office will establish a policy approved as to form by the County Counselor that establishes that all firearms safety training will be conducted under the supervision of deputies certified for such training and that such training will be limited to weapons for which said deputies are certified and that such training will not include any fully-automatic weapons; and,
 
WHEREAS, section 50.535, RSMo, relating to the Sheriff's Revolving Fund, was amended to include the receipt and disbursement of fees and expenses related to the certification of applicants for concealed carry endorsements under Chapter 571, RSMo; and,
 
WHEREAS, the Sheriff's Office has deputies who are certified to provide the required firearm safety training at the facility; and,
 
WHEREAS, there is a certain amount of salvage value in the residue of expended rounds at the facility which can be traded for ammunition for the use of the Sheriff's Office and which should be removed from the facility from time to time to minimize any negative ecological impact; and,
 
WHEREAS, the Sheriff's Office recommends that any fee imposed for the firearms safety training that is provided be deposited in the Sheriff's revolving fund as well as any monies received from the salvage value of spent ammunition at the facility; and,
 
WHEREAS, the Sheriff's Office also recommends that it be authorized to recover such salvage from the facility and to trade the recovered materials against the cost of new ammunition for use in purposes authorized by section 50.535, RSMo; and,
 
WHEREAS, these code revisions are in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,
 
BE IT ORDAINED by the County Legislature of Jackson County, MO as follows:
 
Section A.  Enacting Clause.  Section 7046. and Schedule II to chapter 70, Jackson County Code, 1984, are hereby repealed, and one new section and one new schedule enacted in lieu thereof, to be known as section 7046. and Schedule III, to read as follows:
 
7046.      Fees.
The Sheriff shall cause to be collected fees for services as are set out in Schedules I, II, and III to this chapter.   Fees for the services set out in Schedule I shall be collected and deposited in the county treasury to the credit of the sheriff's training fund.  Fees for the services set out in Schedule II shall be collected and deposited in the county treasury to the credit of the general fund.  Fees for the services set out in Schedule III shall be collected and deposited in the county treasury to the credit of the sheriff's revolving fund.  
 
      7046.1.       Salvage Recovery of Ammunition.
 
In addition to the fees authorized by this section, the Sheriff shall cause the collection of spent ammunition for presentation for salvage value at any designated County facility authorized for use by the Sheriff's Office as a gun range. Any salvage proceeds obtained thereon shall be deposited in the county treasury to the credit of the sheriff's revolving fund as a Schedule III fee and used for the purchase of new ammunition from a licensed firearms dealer as a permitted expense under Sections 50.535 and 571.111, RSMo.
