AN ORDINANCE appropriating $40,000.00 from the unappropriated surplus of the 2005 Recorder's Recorder Technology Fund and authorizing the purchase of Electronic Recording Software for use by the Records Department to Hart InterCivic, Inc., of Dallas, TX, at a cost to the County not to exceed $40,000.00, as a sole source purchase.

Body
WHEREAS, the Records Department desires to purchase and install an upgrade of the Hart InterCivic system for use in the Department's role as the County's recorder of deeds for processing paperless on-line submissions for electronic recording of real estate documents; and,
WHEREAS, the Purchasing Director recommends a contract with Hart InterCivic, Inc., of Dallas, TX, for purchase of Electronic Recording Software for use by the Records Department as a sole source purchase; and,
WHEREAS, Section 1040.1 of the Jackson County Code, 1984, eliminates the requirement for competitive bidding when items to be purchased can be obtained from only one source; and,
WHEREAS, Section 1063.00 of the Jackson County Code, 1984, requires notification of and approval by the Legislature on such sole source purchases exceeding $25,000.00; and,
WHEREAS, the Director of the Records Department and the Purchasing Director recommend an appropriation in the amount of $40,000.00 from the unappropriated surplus of the 2005 Recorder's Technology Fund to accomplish this purchase; and,
WHEREAS, the County Executive recommends said appropriation as an amendment to her 2005 proposed County budget; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation from the unappropriated surplus of the 2005 Recorder's Technology Fund be and hereby is made:

BE IT FURTHER ORDAINED that award be made as recommended by the Purchasing Director, and that the Purchasing Director be and hereby is authorized to execute an Agreement with Hart InterCivic, Inc., of Dallas, TX, as recommended by the Purchasing Director in a form to be approved by the County Counselor; and,
BE IT FURTHER ORDAINED that the Director of the Department of Finance is authorized to make all payments, including final payment on the contract.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
