AN ORDINANCE amending the zoning districts established by the Unified Development Code by rezoning a certain 10 ± acres from District A (Agricultural) to District RR              (Residential Ranchette) District.

 Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District, so that there will be transferred from District A to District RR, a tract of land described as follows:

Description:

 

RZ-2005-374 (Ron Breon)

 

Description:  A 10 ± acre tract of land generally located ¼ ±  mile north of U.S. Highway 50 on the west side of Al Gossett Road and specifically described as beginning at the N.E. corner of the S.W. ¼ of the N.E. ¼ of Section 21, Township 47, Range 29 in Jackson County, Missouri; thence S 2̊ 21' 07" W along the East Line of said ¼ ¼ for 323.16 feet; thence N 87̊ 39' 45" W for 1345.92 feet to the West Line of said ¼ ¼; thence N 2̊ 11' 31" E along said West Line for 323.16 feet to the North Line of said ¼ ¼; thence S 87̊ 39' 45" E for 1346.82 feet to the point of beginning.  All being subject to easements, restrictions and reservations of record.

 

 

 

Section 2.  The Jackson County Plan Commission, on August 18, 2005 held a public hearing and accepted testimony pertaining to the change of zoning requested by Ron Breon.  This request is consistent with the intent and purpose of the Master Plan, therefore, the Plan Commission voted 8 to 0 to recommend APPROVAL to the County Legislature.  

Section 3.  The Legislature, pursuant to the application of Ron Breon  (RZ-2005-374), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission unanimously recommended APPROVAL of this application in a public hearing on August 18, 2005, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

 Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
