AN ORDINANCE appropriating $145,605.00 from the unappropriated surplus of the 2006 Recorder's Technology Fund and $43,737.11 from the unappropriated surplus of the 2006 Recorder's Fee Fund, rescinding Ordinance 3818, dated September 25, 2006, and awarding contracts for the furnishing of automated indexing software and software upgrades to Hart Intercivic, Inc., of Austin, TX, as a sole source purchase, and computer hardware and software to World Wide Technology, Software House International, and Hewlett Packard, under the current miscellaneous PC hardware and software term and supply contracts, for use by the Records Department, in a total amount not to exceed $189,342.11.

Body
WHEREAS, by Ordinance 3818, dated September 25, 2006, the Legislature did appropriate $145,605.00 from the unappropriated surplus of the 2006 Recorder's Technology Fund and $43,737.11 from the unappropriated surplus of the 2006 Recorder's Fee Funds and authorized a contract for the furnishing of automated indexing software and software upgrades for use by the Records Department to Hart Intercivic, Inc., of Austin, Texas, at a cost to the County not to exceed $189,342.11, as a sole source purchase; and,
WHEREAS, the Director of Finance and Purchasing requests that Ordinance 3818 be rescinded as it is limited to the purchase of software from one vendor, and both software and hardware, from numerous vendors, are required for the project; and,
WHEREAS, the total cost of the project remains the same as was specified in Ordinance 3310; and,
WHEREAS, Section 1040.1 of the Jackson County Code, 1984, eliminates the requirement for competitive bidding when items to be purchased can be obtained from only one source; and,
WHEREAS, Section 1063.00 of the Code requires notification of and approval by the Legislature on such sole source purchases exceeding $25,000.00; and,
WHEREAS, the Director of Finance and Purchasing recommends awarding a contract for the furnishing of automated indexing software and software upgrades to Hart Intercivic, Inc., of Austin, TX, as a sole source purchase, since Hart is the only known provider of upgrades to its proprietary software; and,
WHEREAS, with the adoption of this Ordinance, the Director will purchase the remaining requested computer hardware and software from World Wide Technology, Software House International, and Hewlett Packard, under the current miscellaneous PC hardware and software term and supply contracts; and,
WHEREAS, an appropriation is necessary in order to place the required funds in the proper spending accounts; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriations from the unappropriated surplus of the 2006 Recorder's Technology Fund and the 2006 Recorder's Fee Funds be and hereby are made:

BE IT FURTHER ORDAINED that Ordinance No. 3818, dated September 25, 2006, be and is hereby rescinded; and,
BE IT FURTHER ORDAINED that a contract be awarded to Hart Intercivic, Inc., of Austin, Texas, in the amount of $146,036.00, as a sole source purchase, and that the Director of Finance and Purchasing is authorized to execute for the County any documents necessary to the accomplishment of this award; and,
BE IT FURTHER ORDAINED that the purchases under the existing term and supply contracts be and hereby are authorized; and,
BE IT FURTHER ORDAINED that the Director of Finance and Purchasing be and hereby is authorized to make all payments, including final payment on the contracts.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
