Body
WHEREAS, Menard, Inc., desires to install an underground storm sewer line across park property at its proposed new location at I-70 and Little Blue Parkway in Independence, MO; and,
WHEREAS, the sewer line will discharge storm water runoff from the on-site detention pond to the Little Blue River and requires a permanent easement of 3,133 square feet of County park land adjacent to Little Blue Parkway; and,
WHEREAS, the Director of Parks and Recreation has recommended that the County execute the attached Permanent Easement in favor of Menards, Inc., for this project; and,
WHEREAS, Menards, Inc., has agreed to pay the County easement and processing fees required by the County Code, totaling $3,253.20, and
WHEREAS, these funds are to be used for property acquisition and/or construction for an extension of the Little Blue Trace Trail; and,
WHEREAS, an appropriation is needed to place the funds in the appropriate spending account; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation from the undesignated fund balance of the 2014 Park Fund be and hereby is made:

BE IT FURTHER ORDAINED by the County Legislature of Jackson County, Missouri, that the attached Permanent Easement is hereby approved and that the County Executive is hereby authorized to execute on behalf of the County the Agreement and any other documents necessary to give effect to this Ordinance.

Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
