A RESOLUTION authorizing the County Executive to execute an Easement Agreement granting a permanent easement along multiple tracts of land in Fleming Park fronting Woods Chapel Road in favor of Aquila, Inc., for the installation, operation, and maintenance of guy wires and anchors in connection with the Woods Chapel Road Project, for a total fee to be paid to the County in the amount of $2,620.00.

Body
WHEREAS, by Resolution 16028, dated October 2, 2006, the Legislature did authorize an Easement Agreement with Aquila, Inc., to permit the installation, operation, and maintenance of guy wires on power lines along multiple tracts of land in Fleming Park fronting Woods Chapel Road in connection with the Woods Chapel Road Project; and,
WHEREAS, Aquila, Inc., has now requested an additional permanent easement on park property for the same project; and,
WHEREAS, for this additional easement, Aquila, Inc., has agreed to pay a fee of $.40 per square feet of permanent easement and the easement processing fee, in the total amount of $2,620.00; and,
WHEREAS, the Director has determined that the permanent easement will have no adverse effect to the park property and recognizes the public necessity of the provision of safe electrical service in connection with the project; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the attached Easement Agreement is hereby approved and that the County Executive is hereby authorized to execute the Agreement on behalf of the County.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
