Title
AN ORDINANCE appropriating $93,250.00 from the unappropriated surplus of the 2005 Health Fund and authorizing the County Counselor to execute a settlement with St. Luke's Hospital of Kansas City, Missouri, a division of the St. Luke's Health System, to cover the cost of two inmate medical accounts at a cost to the County not to exceed $93,250.00.

Body
WHEREAS, the County and St. Luke's Hospital of Kansas City, Missouri, a division of the St. Luke's Health System, desire to enter into an Agreement, a copy of which is attached hereto and incorporated by reference herein, wherein St. Luke's Hospital will accept the sum of $93,250.00 as final and full settlement of two inmate medical accounts; and,
WHEREAS, the inmates were referred by the medical services provider for the Department of Corrections without the consent and knowledge of the County and St. Luke's Hospital rendered medical services without realizing that such consent was required; and,
WHEREAS, in order to fund this expenditure, an appropriation is necessary; and,
WHEREAS, the County Counselor recommends said appropriation; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation from the unappropriated surplus of the 2005 Health Fund be and hereby is made:

BE IT FURTHER ORDAINED that the Agreement is hereby approved and that the County Counselor be and hereby is authorized to execute the settlement agreement on behalf of the County; and,
BE IT FURTHER ORDAINED that the Director of the Department of Finance is authorized to make all payments, including final payment on the settlement agreement.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
