Body
BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1. A conditional use permit (CUP) is hereby granted for a period of five (5) years to operate a horse boarding stable and equine training facility as to a 12 + acre tract, described as follows:

Description: The 12 ± acres are generally located ¼ ± of a mile east of Arnette Road on the north side of Major Road and specifically described as the southwest quarter of the northwest quarter and the south 25 acres of the northwest quarter of the northwest quarter of Section 15, Township 48, Range 30, Jackson County, Missouri, except the following described portion thereof: Beginning at the southwest corner of the northwest quarter of Section 15, Township 48, Range 30, Jackson County, Missouri; thence east along the south line of said northwest quarter section, a distance of 135.2 feet; thence northerly 447.40 feet; thence westerly 130.0 feet to a point in the west line of said Section 15, said point being 449.0 feet north of the southwest corner of the northwest quarter of said Section 15; thence south along the west line of Section 15, 449.0 feet to the point of beginning; and also excepting the following: beginning at the west quarter corner of Section 15, Township 48, Range 30, Jackson County, Missouri; thence east along the east-west centerline of said Section 15, 153.09 (deed - 153.2 feet) thence northerly 447.29 feet to the point of beginning of the tract to be herein described; thence westerly 130.00 feet to a point of the west line of said Section 15, said point being 449.0 feet north of the west quarter corner of said Section 15; thence north along said west line 173.68 feet; thence easterly 120.98 feet; thence southerly 174.20 feet to the point of beginning, aka 30810 E. Major Road.


Section 2. The CUP granted by this Ordinance is subject to the following conditions:
The number of horses cared for and boarded shall be limited to no more than 20 horses at a time, once condition three (3) below has been complied with.
No horse shows, commercial concession stands, or tack store shall be staged or operated on the premises.
The applicant shall, within 60 days from the approval date of the CUP, construct covered, three-sided lean-tos in the designated dry-lots on the site plan and construct proper fencing for horses along the entire property that is approved within the CUP area.
Manure shall be handled in a manner that does not create an odor or pest nuisance or a threat to the natural watershed.

Section 3. The Legislature, pursuant to the application of Mark Kiefer (CU-2006-192), requesting approval embodied in this Ordinance and with notice that the Jackson County Plan Commission unanimously recommended approval of this application in a public hearing on October 19, 2006, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
