BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District so that there will be transferred from District A to District RR a tract of land described as follows:
Description:
A 25 ± acre tract of land generally located at the northwest corner of Zumalt Road and Missouri Route F Highway (Outer Belt Road) and more specifically described as:
A portion of the of the Southeast quarter of the Southeast quarter of Section 5 and the Northeast quarter of the Northeast quarter of Section 8, Township 47 North, Range 29 West, Jackson County, Missouri, described as follows:
Commencing at the Northeast corner of said Section 8; thence N 87°56'57"W along the North line of Section 8 for 30.00 feet to the West right of way line of Route "F" Highway for the Point of Beginning; thence S 2°01'02"W along said right of way line for 868.25 feet; thence S 18°42'59"W along said right of way line for 104.40 feet; thence S 2°01'02"W along said right of way line for 100.00 feet; thence S 14°40'55"E along said right of way line for 104.40 feet; thence S 2°01'02"W along said right of way line for 193.75 feet to the South line of the Northeast quarter of the Northeast quarter of Section 8; thence N 87°45'21" W along said South line for 800.01 feet; thence N 2°01'02"E for 1367.85 feet; thence S 88°02'06"E for 800.00 feet to the West right of way line of Route "F" Highway; thence S 2°00'55"W for 9.75 feet to the Point Of Beginning.
Section 2. The preliminary plat "Morning Sun - Lots 1-5," creating a five-lot residential subdivision, is hereby approved.
Section 3. The Legislature, pursuant to the application of Tasunke Witko Development Co. (RZ-2000-211), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission, by a vote of 4-1, recommended this application in a public hearing on November 16, 2000, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
