Body
WHEREAS, the Director of Public Works recommends a proposed Agreement with Tri-County Water Authority ("Tri-County") in which the County will be able to access easements for project construction for the Colbern Road Phase II and III, Project Number 2411 and 2455; and,
WHEREAS, as part of that agreement the Tri-County Water Authority will pay the County the sum of $54,510.00 for the County's budgeted and anticipated cost of relocating and reconstructing Tri-County's water main within thirty (30) days after the County has accepted a relocation bid for the water main and any funds received therefrom will be appropriated by ordinance; and,
WHEREAS, the proposed agreement provides that if an approved change order increases the cost of the relocation of the water main, Tri-County shall pay the additional costs within thirty (30) days after approval of the change order; and,
WHEREAS, the Director of Public Works requests authorization to adjust any contract line item quantities to the extent that there will be no further funding obligation by the County in order to fully utilize budgeted funds without the necessity of seeking legislative review of minor change order details; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the proposed Agreement with Tri-County Water Authority in conjunction with the Colbern Road Phase II and III, Project Numbers 2411 and 2455 in a form to be approved by the County Counselor; and,
BE IT FURTHER RESOLVED that the Director of Public Works be and hereby is authorized to adjust any contract line item quantities to the extent that there will be no further funding obligation by the County in order to fully utilized budgeted funds; and,
BE IT FURTHER RESOLVED that the Director of the Department of Finance is authorized to receive and credit all payments from Tri-County Water Authority under this Agreement to Account Number 004-1502-8060.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
