BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District, so that there will be transferred from District A to District RE, a tract of land described as follows:

Description:

 

The 9.6 ± acres are less than ½ mile west of Buckner Tarsney Road on the south side of Stony Point School Road and specifically described as:

 

A tract of land in the Southeast Quarter of the Southeast Quarter of Section 10, Township 48 North, Range 30 West of the 5th Principle Meridian, in Jackson County, Missouri described as follows: COMMENCING at the Southeast Corner of the Southeast Quarter of said Section 10; thence North 87 degrees 33 minutes 27 seconds West along the South line of the Southeast Quarter of the Southeast quarter of said Section 10, a distance of 663.80 feet; thence North 01 degree 56 minutes 03 seconds East, along the East line of the West one-half of the Southeast Quarter of the Southeast Quarter of said Section 10, a distance of 627.71 to the POINT of BEGINNING; thence North 88 degrees 04 minutes 01 seconds West a distance of 200.00 feet; thence North 01 degree 56 minutes 03 seconds East, a distance of 654.00 feet to a point on the Southerly right-of-way line of East Stony Point School Road as now established; thence North 88 degrees 04 minutes 01 second West, along said Southerly line, a distance of 64.30 feet; thence South 01 degree 54 minutes 40 seconds West a distance of 654.00 feet; thence North 88 degrees 04 minutes 01 seconds West a distance of 400.00 feet to a point on the West line of the Southeast Quarter of the Southeast Quarter of said Section 10; thence North 01 degree 54 minutes 40 seconds East, along said West line, a distance of 694.00 feet to a point on the North line of the Southeast Quarter of the Southeast Quarter of said Section 10; thence South 88 degrees 04 minutes 01 seconds East, along said North line, a distance of 664.31 feet to a point on the East line of the West one-half of the Southeast Quarter of the Southeast Quarter of said Section 10; thence South 01 degrees 56 minutes 03 seconds West, along said East line, a distance of 694.00 feet to the POINT of BEGINNING, Containing 9.62 acres more or less.

 

 

Section 2.   The Legislature, pursuant to the application of Bruce Barnhart and Matthew Baker (RZ-2004-334), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on March 18, 2004, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
